AI Products Supplementary Terms

These artificial intelligence (“AI”) products supplementary terms (the “AI Products Supplementary Terms”) form a part of the Smallpdf Privacy Notice and Smallpdf Terms, as applicable, between you and Smallpdf (the “Agreement”). When individual terms are agreed between you and Smallpdf, those should also form part of the Agreement. These AI Products Supplementary Terms apply to your access and use of any Smallpdf AI-powered products and feature(s) such as Chat with PDF, AI PDF Summarizer, Translate PDF and other AI-powered products that might be released by Smallpdf in the future. Any terms used herein have the same meaning as in the Agreement. 

“Smallpdf AI Products” means any feature(s) or functionality made available by Smallpdf and labelled as Chat with PDF, AI PDF Summarizer, or Translate PDF and other AI-powered products that might be released by Smallpdf in the future that utilize data models trained by machine learning. 

Subscription Term and Subscriptions. Smallpdf AI Products are not priced separately and come with your standard Smallpdf subscription. Your use of Smallpdf AI Products is subject to fair usage restrictions. You acknowledge and agree that if you exceed the permitted usage, Smallpdf may disable or degrade the performance of such Smallpdf AI Products’ features. 

Improving Smallpdf AI Products. Smallpdf does not use your Customer Data or permit others to use your Customer Data to train the machine learning models used to provide the Smallpdf AI Products. Your use of the Smallpdf AI Products does not grant Smallpdf any right or license to your Customer Data to train our machine learning models. Artificial intelligence and machine learning models can improve over time to better address specific use cases. We keep your usage data in Smallpdf internal database to improve your experience, but we won’t share it with OpenAI to train their models, and we will delete your usage data from our internal database after 90 days. 

Input and Output. You may provide input to be processed by Smallpdf AI Products (“Input”), and receive output generated and returned by Smallpdf AI Products based on the Input (“Output”). When you use Smallpdf AI Products, Input and Output are your Customer Data. You are solely responsible for the development, content, operation, maintenance, and use of your Customer Data. You will ensure that your Input and use of Smallpdf AI Products and Output will not (i) violate any applicable law; (ii) violate these AI Products Supplementary Terms and the Agreement; or (iii) infringe, violate, or misappropriate any of our rights or the rights of any third party. You acknowledge that due to the nature of machine learning and the technology powering Smallpdf AI Products’ features, Output may not be unique, and Smallpdf AI Products may generate the same or similar output to Smallpdf or a third party. 

Smallpdf AI Products Feature Use Restrictions. You may not use Smallpdf AI Products or Output (i) to develop foundation models or other large-scale models that compete with Smallpdf or Smallpdf AI Products; (ii) to mislead any person that Output from the Services was solely human generated; (iii) to generate spam or content for dissemination in electoral campaigns, or (iv) in a manner that violates any technical documentation, usage guidelines, or parameters.

WARRANTY DISCLAIMER. SMALLPDF DOES NOT MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF SMALLPDF AI PRODUCTS OR THE ACCURACY OF ANY OTHER INFORMATION OBTAINED THROUGH SMALLPDF AI PRODUCTS. YOU UNDERSTAND AND AGREE THAT ANY MATERIAL AND/OR DATA OBTAINED THROUGH THE USE OF ANY SMALLPDF AI PRODUCTS’ FEATURE IS DONE AT YOUR SOLE RISK. YOU SHOULD NOT RELY ON FACTUAL ASSERTIONS IN OUTPUT WITHOUT INDEPENDENTLY CHECKING THEIR ACCURACY. OUTPUT THAT APPEAR ACCURATE BECAUSE OF THEIR DETAIL OF SPECIFICITY MAY STILL CONTAIN MATERIAL INACCURACIES. SMALLPDF AI PRODUCTS CANNOT DYNAMICALLY RETRIEVE INFORMATION, AND OUTPUT MAY NOT ACCOUNT FOR EVENTS OR CHANGES TO UNDERLYING FACTS OCCURRING AFTER THE AI MODEL WAS TRAINED. NO INFORMATION OR ADVICE, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM SMALLPDF OR THROUGH SMALLPDF AI PRODUCTS SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN. SMALLPDF’S LIABILITY ARISING FROM OR IN RELATION TO THE USE OF ANY SMALLPDF AI PRODUCTS IS EXCLUDED TO THE EXTENT PERMITTABLE BY APPLICABLE LAWS. 

Service Level Terms Are Not Applicable. Notwithstanding anything to the contrary in your Agreement, downtime of Smallpdf AI Products that results from a failure of a third-party service will not be included in the availability and downtime calculations. No service levels shall apply to Smallpdf AI Products. 

Third-Party Provider Policies. If you choose to use any Smallpdf AI Products, you may not use them in a manner that violates any terms & policies of OpenAI.
